Comprehensive Consent, Responsibility, Privacy & Liability Agreement By submitting this form and selecting I Consent”, I confirm that I have carefully read, understood, and voluntarily agree to the following terms governing my interaction with LyLaSense, its website lylasense.com, and any services provided through its parent organization, founders, directors, management, operators, employees, facilitators, independent contractors, consultants, affiliates, and hired professionals (collectively referred to as “LyLaSense”). Submission of this form constitutes a digital acknowledgment and legally valid consent to these terms. --- 1. Nature and Scope of Services I understand that LyLaSense provides ethical, consent-based, platonic emotional wellbeing support services designed to encourage respectful human connection, emotional grounding, and compassionate interpersonal interaction. Services may include but are not limited to: * Emotional support conversations * Structured wellbeing interactions * Consent-based comfort support * Online sessions * In-person sessions * Supportive human presence intended for emotional grounding I acknowledge that all services are: * Strictly platonic * Non-sexual in nature * Professional and boundary-aware * Ethically guided LyLaSense services do not constitute medical care, psychotherapy, counselling, psychiatric treatment, or regulated healthcare services, unless explicitly provided independently by a licensed professional. LyLaSense does not diagnose, treat, cure, or prevent any medical or psychological condition. --- 2. Voluntary Participation Participation in LyLaSense services is entirely voluntary. I understand that my participation is based solely on my own decision and personal expectations. LyLaSense does not guarantee specific emotional, psychological, or personal outcomes from any interaction or session. --- 3. Age Declaration and Legal Capacity By consenting to this agreement, I confirm and warrant that: * I am 18 years of age or older * I possess the legal capacity to provide informed consent * My participation complies with the laws of India Age verification is the responsibility of the participant. LyLaSense may request identity documentation when necessary; however, failure to verify age prior to service does not transfer responsibility to LyLaSense. If any participant is discovered to be under the legal age, LyLaSense reserves the right to terminate services immediately. --- 4. Consent and Personal Boundaries All interactions operate under principles of: * Explicit and voluntary consent * Personal dignity and respect * Ethical and professional conduct * Clearly defined interpersonal boundaries Any behaviour that is inappropriate, coercive, abusive, sexually suggestive, manipulative, unlawful, or disrespectful may result in immediate termination of services without refund. LyLaSense reserves the right to refuse, suspend, or discontinue services at its sole discretion. --- 5. Privacy and Confidentiality Information provided through this form or during communication may be collected for purposes such as: * Scheduling services * Communication and coordination * Operational safety and record keeping LyLaSense will make reasonable efforts to protect confidentiality and will not intentionally sell, rent, or disclose personal information to third parties, except: * When required by law * When necessary to protect safety or prevent harm * When explicitly authorized by the participant Participants acknowledge that absolute data security cannot be guaranteed in digital environments. --- 6. Code of Conduct Participants agree to behave respectfully and refrain from: * Harassment or intimidation * Sexual advances or inappropriate requests * Manipulation or coercion * Threatening or abusive behaviour * Misrepresentation of identity Violation may result in termination of services and restriction from future participation. --- 7. Assumption of Emotional Risk I understand that emotional wellbeing interactions may involve personal reflection, vulnerability, or emotional expression. I acknowledge that emotional responses may vary and may include temporary discomfort or introspection. By participating, I voluntarily assume all emotional and psychological risks associated with such interactions. --- 8. Non-Dependency Clause LyLaSense services are intended for temporary emotional support and respectful interaction, not for establishing ongoing emotional dependency. Participants agree not to seek exclusive personal relationships with LyLaSense staff or facilitators. LyLaSense reserves the right to limit or discontinue services where emotional dependency may arise. --- 9. Misinterpretation Protection Participants acknowledge that LyLaSense services involve supportive interpersonal interaction that may include conversation, presence, or other consent-based supportive practices. I agree that such interactions shall not be misinterpreted, misrepresented, or publicly portrayed as romantic, sexual, exploitative, or unlawful activities. Any intentional misrepresentation of services may result in legal action. --- 10. Independent Interaction / No Employment Relationship Participation in LyLaSense services does not create any employment, partnership, agency, or personal relationship between participants and LyLaSense personnel. Operators, facilitators, and professionals may function as independent service providers or contractors. Participants agree not to claim or imply any formal personal relationship beyond the scope of the service interaction. --- 11. Hold Harmless Agreement By providing consent, I voluntarily agree to release, discharge, and hold harmless: LyLaSense, its parent organizations, founders, directors, management, operators, staff members, contractors, facilitators, consultants, affiliates, and hired professionals from any claims, disputes, damages, losses, liabilities, or causes of action arising directly or indirectly from my voluntary participation. --- 12. Indemnification I agree to indemnify and defend LyLaSense and all associated parties against any claims, liabilities, damages, losses, legal actions, costs, or expenses (including legal fees) arising from: * Misuse of services * Violation of these terms * Personal misconduct * False declarations regarding identity or age * Any act causing harm, dispute, or legal exposure --- 13. Limitation of Liability To the fullest extent permitted under applicable law, LyLaSense and its associated parties shall **not be liable for indirect, incidental, consequential, emotional, reputational, or financial damages** arising from participation. Participation is undertaken at the participant’s own risk and discretion. --- 14. Defamation Protection Participants agree not to make false, misleading, or defamatory statements regarding LyLaSense, its services, staff, or affiliated professionals. Any attempt to intentionally damage the reputation of LyLaSense through misrepresentation may result in appropriate legal action. --- 15. Intellectual Property All content, branding, materials, and service descriptions associated with lylasense.com remain the intellectual property of LyLaSense, unless otherwise stated. Unauthorized reproduction or distribution is prohibited. --- 16. Governing Law and Jurisdiction This agreement shall be governed by the laws applicable in Kerala and the laws of India. Any disputes shall be subject to the jurisdiction of the competent courts located within Kerala. --- 17.
